TERMS AND CONDITIONS OF CONTRACT

1. Booking and Payment Policy

Thank you for choosing an ANDESHELIBIKE experience. Your booking is a commitment to ensuring your adventure.

1.1. Booking Confirmation

  • Deposit Required: Your spot is considered secured and the reservation is confirmed upon receipt of a deposit equivalent to 50% of the total tour value .
  • Confirmation: We will send you written confirmation from ANDESHELIBIKE upon receiving this deposit.

1.2. Payment of the Remaining Balance

  • The outstanding balance must be paid in full and effectively received by ANDESHELIBIKE before the start of the contracted activity or service.
  • Please make the remaining payment on time, as failure to pay in full before the start of the activity may result in your spot being released and reassigned to another customer.

2. Recommendation and Cancellation Policy

2.1. Travel Insurance Recommendation

Due to the nature of adventure activities and the cancellation clauses detailed below, we strongly recommend that all our clients purchase Travel Cancellation Insurance through third-party providers (such as Travel Guard or other reputable insurance companies). This insurance will provide coverage should you need to cancel due to unforeseen personal reasons.

2.2. Cancellation Requested by the Client

The cancellation policy applies according to the advance notice given for the cancellation request:

  • Cancellation more than 30 days in advance: A full refund of the amount paid will be issued, deducting only non-recoverable administrative expenses and/or bank fees incurred.
  • Cancellation 30 days or less before departure: Unfortunately, due to preparation costs already incurred (such as permit arrangements and helicopter operator bookings), cancellations requested within this timeframe do not entitle you to a refund of the fees paid.
    • Note: Only in cases of proven force majeure and under the exclusive criteria of ANDESHELIBIKE, a percentage of refund may be evaluated, although this is not guaranteed.

2.3. Cancellation by ANDESHELIBIKE (Reasons Not Attributable to Force Majeure)

If the company cancels the tour for operational or logistical reasons other than those considered Force Majeure, a full and complete refund of the payment received is guaranteed, deducting only bank commissions for the use of credit or debit cards, if any.

3. Refund Policy for Force Majeure Events

We consider force majeure to be unforeseeable situations beyond our control, such as adverse weather conditions (that prevent the operation of the helicopter or the use of routes), the state of trails, political situations, natural disasters or pandemics.

If we are unable to carry out the tour for these reasons, we offer you the following options:

  1. Rescheduling Option: We will immediately propose itinerary modification alternatives or new dates to reschedule your tour.
  2. Credit Option (Voucher): If you do not accept the rescheduling alternatives, you will be granted a credit equivalent to 100% of the amount paid . This credit will be available in the customer's account for a period of two (2) calendar years to be used for future bookings with ANDESHELIBIKE.
  3. Refund Option: If the above options are not suitable, a refund will be offered. In this case, the amount paid will be refunded , less any non-recoverable administrative and preparation costs already incurred for the tour.

4. Operational Provisions

4.1. Empty Seats and Operational Safety

ANDESHELIBIKE reserves the right to fill empty seats on tours. Our guides and staff may use these seats to ensure safety, logistical support, and the smooth running of the activity.

4.2. Suitability and Exclusion Conditions for Safety

  • Participation in our tours requires an adequate level of physical and mental fitness.
  • The company may refuse participation or require withdrawal from the tour from any person who, in the opinion of the guides or staff, puts their own safety or that of the group at risk.
  • In such cases, the passenger will be responsible for all additional expenses incurred, including rescue costs, transfers, and any other expenses resulting from their exclusion.

4.3. Responsibility and Exclusions

ANDESHELIBIKE is not responsible for:

  • Loss, damage or theft of luggage, bicycles, personal equipment or tickets.
  • Additional expenses caused by breaches or delays in transport services.
  • Any circumstances outside our direct control, including extreme weather conditions, pandemics, natural disasters, terrorist acts, or government regulations.

The applicable legislation and jurisdiction for the resolution of any dispute will be that of the Republic of Chile.
